Terms and Conditions

These terms govern how you access and use DAC-A11y services. By continuing to use the site, you agree to the responsibilities, limits, and rights outlined below.

Acceptance & Eligibility

  • These terms form a binding agreement between you (or the organization you represent) and DAC-A11y when you browse, sign in, or submit content.
  • You must have authority to bind your organization and be of legal age to enter contracts in your jurisdiction.
  • We may update these terms periodically. Continued use after updates constitutes acceptance of the revised terms.

Accounts, Access & Acceptable Use

  • You are responsible for safeguarding credentials, API keys, and tokens issued to your workspace and for actions taken with them.
  • Only scan or upload content you have rights to test. Do not submit malicious code, illegal material, or data classified as sensitive under applicable law without prior written consent.
  • Service availability may vary by role (e.g., admin features, Alt Text Lab, and remediation tools require eligible licenses and permissions).
  • We may suspend or restrict access for suspected abuse, security risks, or non-compliance with these terms.

Uploads, Scans & Cloud Drives

  • Uploads (local files, clipboard images, cloud-drive selections, and pasted links) are processed solely to generate accessibility findings, remediation, or alt text and then handled per our Privacy Policy.
  • Cloud drive features (including Google Drive My Drive and Shared Drives multi-select) rely on delegated tokens you authorize; you must ensure your selections are permitted by your organization.
  • Password-protected or corrupted files may fail processing. You are responsible for removing restrictions or providing accessible copies.
  • Temporary processing artifacts and operational logs may be retained briefly for troubleshooting before deletion or minimization.
  • Automated remediation and checks improve accessibility but do not guarantee WCAG conformance. You must perform manual review, confirm screen reader compatibility, and address any residual issues.

API Keys & Automation

  • Administrators can issue, rotate, and revoke API keys with per-user limits. Keys must be stored securely and used only for authorized automation against DAC-A11y endpoints.
  • You must promptly rotate or revoke keys suspected of compromise. We may throttle, audit, or block keys that degrade system stability or violate these terms.
  • API usage is subject to applicable rate limits, auditing, and workspace-level policies.

Payments, Billing & Trials

  • Subscriptions, credit bundles, and invoices are handled through our payment processors. You authorize recurring charges until you change plans or cancel per the platform flow.
  • Fees are non-refundable except where required by law or explicitly stated during a promotion or trial.
  • Access to premium features may pause when payments fail; service will resume once a valid payment method is provided.

Privacy, Security & Intellectual Property

  • Our Privacy Policy describes how data is collected, used, and retained. These terms incorporate that policy by reference.
  • We implement encryption, role-based access, and monitoring to safeguard workspaces, but you acknowledge that no system is entirely immune from incidents.
  • All DAC-A11y software, content, and branding remain our intellectual property. You grant us a license to process submitted content solely to provide the services.
  • Providing feedback or suggestions grants us the right to use it without obligation or restriction.

Availability, Liability & Termination

  • Services are provided on an “as is” and “as available” basis. We strive for high uptime but do not guarantee uninterrupted access.
  • Our total liability under these terms is limited to the amount you paid for the services during the three months preceding the claim, to the fullest extent permitted by law.
  • You agree to indemnify DAC-A11y against claims arising from your misuse of the services or violation of these terms.
  • We may terminate or suspend access for breach, security risk, or legal requirement. You may stop using the services at any time.

Governing Law & Contact

  • These terms are governed by the laws of the United States and the state where DAC-A11y is organized, without regard to conflict of law principles.
  • Disputes will be resolved in the courts located in that jurisdiction unless another forum is required by applicable law.
